Partner Connection Addendum
The terms you accept when you connect your CrossTrade account to a product built by a CrossTrade partner.
Version 2026-10-22 | This is the text accepted in the CrossTrade application. The version and content hash of the text you accepted are recorded with your account.
Version 2026-10-22. Effective when you expressly accept this version.
This agreement is between you and CrossTrade LLC, a Wyoming limited liability company ("CrossTrade", "we", "us"), when you connect to the independent provider identified on the Connect page (the "Partner"). The Terms of Service, Trading Disclaimer, Privacy Policy and, where AI is used, AI Trading Agents Disclaimer are incorporated. This addendum controls any conflict concerning this connection, including authorized Partner use, account eligibility, access revocation, liability and disputes. You do not become a party to the commercial Partner Agreement.
IMPORTANT: This connection can place real trades and lose money, including because CrossTrade's own technology fails. Section 9 includes a release of certain ordinary-negligence claims and a damages cap. Section 10 requires individual arbitration and waives jury trials and class actions.
1. Who provides what
The Partner provides its own product, strategies, signals, advice, software, fees, billing, refunds, support and security. CrossTrade supplies connection and automation technology. "Powered by CrossTrade" is not endorsement, supervision, certification or a guarantee of the Partner's competence, honesty, financial condition, registration or results. Check the Partner's qualifications and required registrations yourself.
CrossTrade is not a broker, dealer, futures commission merchant, introducing broker, commodity trading advisor, investment adviser, exchange or fiduciary. It does not hold your funds, make investment choices, assess suitability or give investment, tax or legal advice. It is not registered with the CFTC, NFA, SEC or another regulator in those capacities. CrossTrade is not a party to your agreement with the Partner and does not collect or guarantee the Partner's charges. Product and fee disputes go to the Partner; you may contact CrossTrade directly about your authorization, security, privacy or legal rights. Legal duties imposed by law are not displaced by these descriptions.
2. Your account and identity
The current Partner flow creates a separate Partner-managed CrossTrade account using an email not already registered with CrossTrade. It does not attach, merge or transfer an existing retail account or paid subscription. A separate, accurately identified Partner-managed account is permitted even if you have a retail account, but not to obtain extra trials, bypass restrictions, conceal identity or duplicate a broker identity already claimed by another account. Contact CrossTrade about an account or broker-link conflict.
You must be eighteen (18) or older, have legal capacity, control the supplied email address, and own or be personally authorized by the issuing broker or proprietary trading firm to trade each linked account. Complete legal acceptance, broker sign-in and consent yourself. Do not give the Partner your password or session cookie, and do not let anyone else use your Connect link.
While managed, you use the Partner product rather than the retail CrossTrade dashboard. CrossTrade suppresses marketing but may send security, service, privacy and legal notices. You can ask CrossTrade to revoke this connection without the Partner's permission (Section 3). When a Seat ends, your account ordinarily becomes a free CrossTrade account you can access after setting a password, subject to security, deletion or other lawful restrictions. No paid retail subscription is purchased automatically. CrossTrade marketing requires your choice to receive it.
3. Authorization and revocation
You choose which broker login identities and available permissions to share. An identity may contain multiple broker accounts, including accounts subsequently associated with that identity, as the broker and scope permit. Read permissions can expose balances, positions, orders and fills. Trading permissions can place, change or cancel orders and close positions. Management permissions can create or modify automation. Access is also limited by the environments and permissions CrossTrade enables for the Partner. CrossTrade does not disclose your broker or CrossTrade login password to the Partner.
Instructions the Partner submits within your authorization are instructions you permit it to submit on your account. CrossTrade performs technical validation and access checks, not investment review or suitability analysis. Technical acceptance of a request is not confirmation that a broker accepted, executed, changed or cancelled an order. Unauthorized conduct does not become lawful merely because a credential was used.
Revoke independently: ask the Partner, or email support@crosstrade.io from the email address associated with this account. You do not need the Partner's approval or retail dashboard access; CrossTrade may verify your identity before acting. If you cannot reach CrossTrade, use your broker's own controls and contact the broker directly. Do not wait for support to manage an urgent position.
Revocation blocks further requests under the revoked grant once enforced, but cannot recall requests already submitted or undo fills. It does not itself close positions or cancel broker-held protective or working orders. Partner-created copiers stop further copying when revocation is enforced. Existing protective monitors may continue under your remaining account access and configuration; they can still fail, and account termination or broker disconnection may stop them. Verify and manage all positions and controls directly with the broker. Revoking a grant does not necessarily end the Partner's subscription or Seat funding, or cancel your separate agreement or charges with the Partner.
CrossTrade's access rights: to the fullest extent permitted by law, CrossTrade may refuse, narrow, suspend, disable or revoke any connection, account, Seat, feature or authorization at any time, in its sole discretion, for any lawful reason or no stated reason, with or without cause and with or without advance notice, including during market hours. Examples such as security, legal requirements, business decisions, complaints or non-payment do not limit this right. No cure period is promised. Mandatory notice, refund and other nonwaivable rights remain. Be able to manage your accounts without CrossTrade or the Partner.
4. Technology and trading risks
Futures, options and foreign-exchange trading can lose all or more than your investment. Use only risk capital. Past, hypothetical and simulated results do not predict future results. The Trading Disclaimer, including its hypothetical-performance disclosures, applies.
CrossTrade's own systems can fail. Failures may arise in CrossTrade software, servers, hosting, routing, authentication, updates, maintenance, personnel, risk controls or operations; in the Partner or broker; or from a combined or unknown cause. Ordinary negligence, bugs, outages, stale data, partial fills, latency, duplicate or missing messages, token expiry, rate limits and failed recovery may cause incorrect orders, missed exits or unmanaged positions even when you configured everything correctly. A timeout does not prove an order failed; retrying can duplicate it. Verify outcomes with the broker.
Stops, loss limits, flatten commands, monitors, copiers and alerts are not guarantees. CrossTrade's own defects as well as external systems and market conditions can prevent or delay them or produce a worse price. A limit is not a cap on losses. Notifications may arrive late or never arrive. Maintain direct broker access, independently monitor your accounts and use broker-held protection where appropriate. Test in simulation first, but do not assume successful tests establish live reliability. AI may fabricate, misinterpret or act on stale information, as the AI Trading Agents Disclaimer explains.
You must comply with your broker's and proprietary trading firm's current rules. A CrossTrade feature does not prove that its use is allowed. Failed evaluations, funding revocations, denied payouts and similar consequences may result. CrossTrade does not guarantee profitability, continuity, regulatory compliance or the Partner's performance.
5. Your decisions and permitted use
Whether to connect, which permissions to grant, whether to follow the Partner and when to disconnect are your decisions. Nothing CrossTrade provides is a recommendation, solicitation, suitability assessment or investment advice.
Notwithstanding Sections 2A, 13, 15B, 15D, 17B and 17K of the Terms of Service and corresponding restrictions in the Trading Disclaimer, you may use and pay for this authorized Partner Product through the Partner Platform within your authorization and applicable law. This exception does not permit pay-to-pass activity, Signal Share between different people, credential sharing, your trading for other people, or violations of broker or Prop Firm rules. It is not a representation that the Partner satisfies its regulatory obligations.
6. Fees
The Partner pays CrossTrade for the Seat; CrossTrade does not charge you for granting this connection. Your payments to the Partner are governed by your agreement with it and do not count as payments to CrossTrade. Any separate direct CrossTrade purchase is governed by its disclosed pricing and the Refund & Cancellation Policy, subject to mandatory law.
7. Information and evidence
CrossTrade receives the name, email and customer reference supplied during enrollment. It shares enrollment and connection status and, within your authorization, broker identities and account identifiers, balances, positions, orders, fills, automation configuration, action results and events with the Partner. Read the Partner's own privacy notice, including its vendors and AI providers. CrossTrade's processing is described in its Privacy Policy; each organization's legal role follows its actual processing and applicable law.
CrossTrade records document versions and content hashes, acceptance time, account and session references, verification method, available network address and browser information, authorization scope and audit evidence. Contract, authorization, notice and necessary dispute evidence may be kept after account deletion as described in the Privacy Policy, separately from routine 90-day operational logs. Copies may be requested from privacy@crosstrade.io. Your privacy and deletion rights do not depend on Partner approval. For account deletion, use the Account and Data Deletion procedures, including direct email requests while managed.
8. Your responsibilities
Keep information accurate, secure your devices and credentials, personally review and accept, monitor broker outcomes and Partner activity, withdraw unwanted authorization promptly, maintain independent broker access and records, handle applicable taxes, and comply with law and account rules. CrossTrade support cannot promise to intervene before a loss occurs.
9. Disclaimers, release and liability
Protected parties. "CrossTrade Parties" means CrossTrade and its affiliates, members, managers, directors, officers, employees, contractors, agents, licensors, suppliers, successors and assigns. The independent Partner is not included merely because it uses CrossTrade.
As is. To the fullest extent permitted by law, the connection and CrossTrade technology are provided "as is" and "as available", without express, implied or statutory warranties, including merchantability, fitness, title, non-infringement, accuracy or availability. CrossTrade does not guarantee uninterrupted or secure access, error correction, timely warnings or order execution. Support statements do not create a warranty.
ASSUMPTION OF RISK AND LIMITED RELEASE. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU VOLUNTARILY ASSUME THE ECONOMIC TRADING RISKS DESCRIBED HERE AND RELEASE THE CROSSTRADE PARTIES FROM CLAIMS FOR TRADING LOSSES ARISING FROM THIS CONNECTION, INCLUDING THEIR OWN ORDINARY NEGLIGENCE, SOFTWARE DEFECTS, ERRORS AND OMISSIONS. This covers failures originating in CrossTrade's own systems as well as Partner, broker and combined failures. It also covers losses resulting from lawful interruption, suspension, withdrawal or revocation. This is not a release of nonwaivable claims or a settlement of an undisclosed existing dispute.
EXCLUDED DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, THE CROSSTRADE PARTIES ARE NOT LIABLE FOR TRADING LOSSES, LOST CAPITAL, LOST PROFITS OR OPPORTUNITIES, ERRONEOUS, DUPLICATED, DELAYED OR MISSING ORDERS, FAILED PROTECTION, PROP FIRM ACCOUNT OR PAYOUT CONSEQUENCES, LOST DATA OR SUBSTITUTE-SERVICE COSTS, WHETHER CLAIMED AS DIRECT OR INDIRECT DAMAGES; OR FOR INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES.
ONE AGGREGATE CAP. TO THE FULLEST EXTENT PERMITTED BY LAW, ALL CROSSTRADE PARTIES' TOTAL COMBINED LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THIS CONNECTION IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID DIRECTLY TO CROSSTRADE FOR ITS SERVICES IN THE TWELVE (12) MONTHS BEFORE THE FIRST EVENT GIVING RISE TO THE CLAIMS AND (B) USD $100. If you paid CrossTrade nothing, the cap is $100. Payments to the Partner and fees the Partner pays CrossTrade do not increase it. The cap applies collectively, not separately per person, event, claim, document or legal theory. Recovery for the same loss under incorporated terms counts toward the same cap and is not cumulative. Expressly owed refunds are not reduced by the cap.
These provisions apply in contract, tort (expressly including ordinary negligence), warranty, strict liability and otherwise, even if a loss was foreseeable, CrossTrade was warned, or a remedy fails its essential purpose. CrossTrade Parties may enforce them as intended third-party beneficiaries.
Rights preserved. Nothing in this addendum or any incorporated CrossTrade document releases or limits fraud, willful misconduct, gross negligence, or any liability, remedy or duty that law prohibits limiting. Nonwaivable consumer, privacy, securities and commodities-law protections, mandatory refund rights, lawful regulator reports and truthful reviews remain. No general-release or unknown-claims waiver in an incorporated document overrides this paragraph. Applicable mandatory law controls over inconsistent language.
Your indemnity. Section 19 of the Terms of Service applies, including for any claim arising from your breach of this addendum, your misuse of the connection, or your violation of a broker's, exchange's, platform's or proprietary trading firm's rules.
10. Disputes with CrossTrade
Section 22 (Arbitration Agreement) and Section 23 (Choice of Law and Venue) of the Terms of Service apply to every dispute between you and CrossTrade relating to this connection: Wyoming law governs, disputes are resolved by binding individual arbitration administered by the American Arbitration Association in Wyoming, you and CrossTrade each waive a jury trial and class, collective or representative proceedings, and claims must be brought within one (1) year where the law allows that limit. Either party may bring an individual claim in small-claims court where that court has jurisdiction. Disputes between you and the Partner are governed by your own agreement with the Partner; this agreement does not make CrossTrade responsible for them.
11. Changes and electronic acceptance
For an existing connection, CrossTrade will give at least thirty (30) days' notice of a material change by direct email or a notice accessible to you, except where law or a genuine security necessity requires an earlier change. The notice identifies the version and proposed effective date. CrossTrade may require express acceptance to continue new activity after that deadline. A website posting, a Partner's signature or payment is not your click acceptance. Earlier express acceptance makes the revised text effective for you; records are not backdated. If you decline, revoke the connection and manage positions directly with your broker.
Your deliberate checkbox and click acceptance is an electronic signature. Electronic records may be used as evidence without preventing a good-faith challenge to their authenticity or attribution. Risk allocation, accrued obligations, lawful retention and dispute terms survive disconnection. If a provision is unenforceable, the rest remains effective to the extent lawful.
By accepting, you confirm that you personally reviewed these documents, meet the eligibility requirements, control the account email and linked broker identities, and accept the disclosed risks, ordinary-negligence release, liability limits and dispute provisions subject to the rights preserved above. Questions about these terms or your connection rights go directly to support@crosstrade.io.
